Important Terms and Conditions
PRIOR TO UTILIZING THIS SITE, YOU SHOULD READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. THESE TERMS AND CONDITIONS GOVERN THE USE OF THIS WEBSITE AND OUR SERVICES. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS YOU ARE UNDER NO OBLIGATION TO CONTRACT OUR SERVICES.
PURPOSE
The Purpose of this Client Agreement is to set forth the terms and conditions under which The Resume Fix LLC (The COMPANY) and the client (hereinafter referred to as “The CLIENT” will agree.
Whereas The CLIENT hereby hires The COMPANY to provide career services included in their purchase and that this Client Agreement shall be effective on the date The CLIENT signifies conformity.
NOW, THEREFORE, in consideration of the mutual promises herein contained, the parties agree as follows:
GENERAL
By contracting The COMPANY, you are paying for résumé writing, career coaching and/or related career services. You acknowledge that you have read and agree to these terms of service.
The Resume Fix name is protected by trademark laws and materials included within our website and shared with you during the course of this Agreement are protected by copyright laws.
SERVICES POLICY
To ensure timely turnaround of services, it is imperative that you respond promptly to all requests for information, as the basis of your services delivery is based upon the information that you initially provide to us.
All work will be carried out based upon the following:
1. Information provided by you through the company website;
2. Documents that you submit directly to The Resume Fix;
3. Direct telephone contact and information transmitted via e-mail;
3. Any other forms of contact such as documents sent by fax or postal service mail, as well as in-person meetings.
DESCRIPTION OF WORK TO BE PERFORMED
Description of services to be provided:
- Résumé, cover letter, LinkedIn profile, biography, and other written documents are developed based upon an initial 30-minute scheduled consultation, a customized questionnaire, and supporting documentation.
- LinkedIn content will be provided through a LinkedIn Delivery Document, which includes basic instructions for The CLIENT to upload content to their LinkedIn account. Under no circumstances will The Company require access to The CLIENT’S LinkedIn account username or password.
- Career Coaching services are provided based upon an initial 30-minute scheduled consultation in addition to customized intake forms, questionnaires, and supporting documentation.
- Résumé Distribution services are delivered based upon an initial 30-minute scheduled consultation, a customized questionnaire, supporting documentation, and any follow-up phone calls or emails required to collect necessary information.
Revisions
Due to the unique nature of our work, if revisions or additions are required to documents we have written, you must notify The Resume Fix within the allotted time frame. We work very hard to please every client and our goal is to provide a satisfactory document with your first draft. However, we offer a revision policy that allows for reasonable revisions.
You are allotted up to two rounds of edits of decreasing complexity, for each document within your order.
Editing includes reviewing, proofreading, modifying, and making minor changes to your documents. Editing does not include rewriting, reformatting, or revamping a document. Additional fees will apply for extensive edit requests.
Extensive edit requests are those that are so substantial that our work and opinion as professional writers is hindered and/or negated. In instances such as these you agree to waive your right to the 60-day interview guarantee.
You may request these two rounds of revisions within 30 business days of receiving your initial drafts from us for review. Standard revisions requested after this time frame will not be honored and will incur additional charges.
Additional or new information introduced after initial drafts have been shared with The CLIENT will generate additional fees for consultation and writing services at the rate of $49/half hour, billed in 30-minute increments and due prior to draft delivery.
Payment Policy
Use of our services is subject to the payment of a fee (the “SERVICE FEE”) in the amount set forth on the website at the time of purchase. All SERVICE FEES shall be pre-paid via a major debit card, credit card, bank ACH or AfterPay. The COMPANY will not provide any service without payment of fees in full.
Partial AfterPay Approvals Policy
Please note, that full payment is required before we can begin work on any project. If AfterPay does not approve the full amount due for your project, and you have a remaining balance, you must make other arrangements to pay this balance in full. Accepted methods of payment include major debit cards, credit cards, bank ACH transfers, or our in-house installment plan. Your project will only commence once the full payment has been received and processed.
Notice of Abandonment, Expiration, & Forfeiture of Services.
The CLIENT acknowledges that after 60 days of no contact or where no action has been taken to progress the project forward, that the order will be considered abandoned, and no refunds will be issued. In such instances, the CLIENT may still move forward with the steps necessary to progress their project forward.
After one year of no contact or where no action has been taken to progress the project forward, the order will expire one year from the original date of purchase. In such instances, the purchase will be deemed forfeited and a new order must be placed to re-activate services.
Abandoned, expired, and forfeited services are not eligible for a refund.
First Drafts
After all pertinent information has been received and researched, we will send you a first draft of your documents within 7-10 business days (excluding holidays). You will be given 30 days to review the accuracy of this content. If after 30 days we have not received a request for updates from you, we will assume that you accept the content as is, and your order will be finalized. All documents completed by The Resume Fix will be sent to you electronically in both Microsoft Word and Adobe Acrobat PDF formats.
Third Party Feedback
Third party feedback includes creative suggestions, ideas, notes, drawings, concepts, documents, or other information (“FEEDBACK”) that you solicit from other parties or services outside of The Resume Fix. You agree that solicitation of such FEEDBACK is at your own risk and that The COMPNAY has no obligations with respect to such feedback.
Project Finalization
After 30 days, all projects will be considered approved and complete, and additional work will be billed at the rate indicated on our website for Returning Clients. All Changes after finalization — including The CLIENT’S discretionary revisions — are subject to these additional charges at The COMPANY’S current rate for such services as indicated on The COMPANY’S website.
REFUNDS
The COMPANY’S refunds policy is as follows:
Refunds for Written Documents
Because of the unique nature of writing services (the final product/service is custom created for The CLIENT, cannot be re-sold, and because of the number of hours required to collect information from you, and to construct your documents), we do not refund service payments if the first drafts have already been sent to The CLIENT.
However, The CLIENT’S satisfaction is always priority. We will revise the documents based upon the two rounds of edits included within the order, in addition to our 60-day interview guarantee.
If The CLIENT needs to cancel their order prior to the document(s) being sent to them, then notify The COMPANY immediately. Allow 10-14 business days for processing of refunds in such instances.
Cancellation of written documents is subject to a $149 cancellation fee.
Refunds for Career Coaching
Because of the unique nature of career coaching services (the service is custom created for The CLIENT, cannot be re-sold, and because of the hours required to collect data and construct individualized coaching plans), we do not refund service payments after the coaching relationship has begun.
If The CLIENT needs to cancel their order prior to commencement of their first coaching session, then immediate notification is required. Please allow 10-14 business days for processing of refunds in such instances.
Cancellation of coaching services is subject to a $149 cancellation fee.
Refunds for all other products and/or services
Additional products and services may be provided and may include résumé distribution, DIY guides, and other special writing projects completed upon request, and on a case-by-case basis. Such products and services are non-refundable.
Chargebacks
In the event of a chargeback by the CLIENT'S card company after the first drafts have already been sent to the CLIENT, the Company reserves the right to pursue legal action. The CLIENT has up to 10 calendar days to resolve the issue with the card company before the COMPANY proceeds with further actions. The COMPANY will communicate clearly the consequences if the issue is not resolved within that timeframe. Additionally, the COMPANY will send at least two email communications during this period to ensure that the matter is well-defined before proceeding with legal matters for resolution.
INDEMNIFICATION
The CLIENT acknowledges that The COMPANY is not responsible for work that is not completed in a timely manner due to acts of God, mechanical failure, or other circumstances beyond the control of The COMPANY.
Please note that many e-mail service providers automatically filter inboxes, resulting in messages being directed to junk/spam folders. It is the sole responsibility of The CLIENT to be aware of this and to add The COMPANY to The CLIENT’S address book if necessary. The COMPANY will make every attempt possible to contact The CLIENT and deliver their documents. However, The COMPANY will not be liable for any inability to deliver documents based upon interception by the e-mail service provider or incorrect or invalid e-mail addresses.
The COMPANY is not responsible for technical, hardware, and / or software failures of any kind nor for any issues resulting from same. This is not The COMPANY’S area of expertise.
The COMPANY provides client files in Microsoft Word and Adobe Acrobat PDF formats and does not guarantee documents will retain all of their original, intended formatting and features on client equipment. The COMPANY cannot provide technical support for document formatting or other file compatibility issues due to the wide variety of computer software and hardware available for client use.
CLIENT ASSURANCE OF ACCURACY OF INFORMATION PROVIDED
The Client is responsible for the accuracy of the information provided. The COMPANY will not be responsible for information obtained from The CLIENT that is inaccurate or incorrect. The CLIENT is responsible for accuracy of information included in career documents and should not sign off on projects as finalized without thoroughly reviewing the documents.
The COMPANY is not liable for any injury or damage caused by client omissions, false statements, or other inaccuracies, and will not be responsible for any monetary compensation or attorney fees if a legal dispute arises.
When the CLIENT submits information to The COMPANY, he/she grants a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, edit, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content subject to the company’s Privacy Policy.
The CLIENT grants permission to The COMPANY to use the content of The CLIENT’s career marketing documents and other purchased products and services to be published in articles, columns, books, industry-related publications, and/or training materials at the discretion of The COMPANY. All client-identifying data (name, address, city, email address, phone numbers) will be removed or fictionalized to protect client identify.
WARRANTY DISCLAIMER
The CLIENT understands that The COMPANY will work with The CLIENT in good faith to compose and design exceptional career marketing materials, and provide all services based on the data provided by The CLIENT.
The CLIENT also understands that the documents composed by and services delivered by The COMPANY must be marketed properly by The CLIENT to produce interviews, and that no guarantee of multiple interviews, job offers. or employment is made when utilizing the services of The COMPANY. Rather, success is dependent on each client’s own commitment to their job search, meeting, and exceeding employer(s) requirements. The CLIENT accepts full responsibility for the outcome of any job search campaign and agrees to not hold The COMPANY responsible for lack of employment or job offers, failure to obtain employment, or any other related outcomes.
The CLIENT understands that client success is directly dependent on the effort, commitment, and diligence employed using the new career documents and a variety of job search strategies (applying for advertised positions, networking, social media search, direct contact with potential employers, etc.). Outcomes are affected by many external variables, including market volatility, local and national economies, social conditions, market saturation for a particular industry, client’s level of experience, skills, and education, interviewing skills and abilities, criminal history, and/or prior work history. You understand that the documents composed by and services delivered by The COMPANY must be marketed properly by you, The CLIENT to produce results.
REWRITE POLICY
We offer a 60-day interview guarantee which states the following: “Included with each of our résumés is our 60-day interview guarantee which states that if you do not receive at least one interview after we complete your documents, then we have more work to do. Our team will rewrite your résumé up to one time and at no additional charge to you. We are not happy unless you've received an interview.”
The COMPANY will rewrite any résumé that does not generate interviews after 60 days with the following stipulations:
- The CLIENT has marketed the document properly. Marketing the document properly means that the CLIENT has submitted the résumé to a minimum of 30 open positions;
- The CLIENT has not made any substantial changes to the document prior to submission to each role. Substantial changes is defined as edits to the document that are beyond the scope of those recommended by The COMPANY. We only recommend changes to the applicable keywords and header sections within your document, and only where required;
- The CLIENT can provide proof of submission of their résumé to these job postings, along with the version of the résumé and cover letters submitted to each posting.
Rewrite services are limited to information already provided to the COMPANY and will not include any new information.
In no event shall the services of The COMPANY be construed by a customer as a promise of profit, sales, revenues, or increased wealth or assets. We do not guarantee that any résumé, cover letter, or other service or product offered shall meet or exceed the requirements or expectations of a hiring manager or company.
HOLD HARMLESS AGREEMENT
The Client agrees The Company has created document layouts and content for client’s specific career target, based on generally accepted résumé writing principles and knowledge of hiring processes gained through ongoing training, credentialing, and experience.
The Client agrees that if they request or make one or more changes to the résumé, cover letter, LinkedIn profile, or other career marketing documents that The Company has advised against, or if The Client has received advice and/or guidance and has decided to ignore this advice, and/or if The Company has agreed to make these changes to finalize the project, then the project is subject to The Client agreeing to the provisions of this Hold Harmless Agreement.
Client acknowledges:
1. Following such changes, the information reflected in The Client’s documents are not necessarily the strategy suggested by The Company.
2. Because of the changes made, the work created no longer reflects the true nature, beliefs, and opinions of The Company. The Client is expressly prohibited from publicly or privately acknowledging or representing that the résumé or related career marketing documents was prepared by The Company.
3. The Company will not be bound by any guarantees or other express or implied warranties as to the effectiveness of the career marketing documents written by The Company in light of the changes made. The Company cannot guarantee the effectiveness of the career marketing documents in light of these changes.
4. The Client will not pursue additional changes or corrections — even in (or especially in) the event the résumé or career marketing documents do not generate requests for interviews — under the terms of the original client agreement.
5. Should The Client decide at a later date that changes need to be made to the résumé or other career marketing documents, these services will require payment of an additional fee at The Company’s current billable rate.
By acknowledging and/or signing this agreement, The Client hereby releases, waives, and discharges The Company from any and all claims, demands, and actions. The Client agrees to release The Company from all obligations and acknowledges the project is complete. This agreement indemnifies The Company from any claims by The Client arising out of the use of the modified career documents.
The parties agree not to make any statements — written or verbal — and shall not cause or encourage others to make any statements — written or verbal — that defame, disparage, or in any way criticize the practices, products, conduct, or reputation of The Company or The Client. The Client and Company agree that this extends to statements — written or verbal — made to anyone, including (but not limited to) the news media, industry analysts, competitors, strategic partners, vendors, employees (past and present), potential clients, and current clients.
The parties agree and acknowledge that this non-disparagement provision is a material term of this agreement, the absence of which would have resulted in The Company and/or The Client refusing to enter into this agreement.
Both parties agree that if a breach of the non-disparagement provision were to occur, it would be difficult to determine actual damages. However, based on the value of the reputation of The Client and The Company both parties agree that $3,000 is a reasonable estimate of the damages that would accrue if a breach occurred in the future, and this amount would purchase a basic reputation management remediation program. Both parties agree that the amount of liquidated damages is fair and reasonable and would not act as a penalty to the breaching party. Consequently, if disparagement is confirmed, the breaching party will pay a sum in the amount of $3,000 to the injured party.
TERMINATION
The COMPANY reserves the right to refuse service, terminate a client relationship, or otherwise cancel orders at their sole discretion.
Grounds for immediate termination include, but are not limited to:
- Harassment, abuse, threats, and/or discriminatory actions
- Aggressive language towards any member of staff
- Excessive and/or inappropriate contacts with any member of staff (subject to the company's determination of excessive and inappropriate)
- Or any other conduct that compromises the safety and well-being of the company’s staff or other clients.
Any such behaviors will result in the immediate cessation of all services and the client will forfeit any fees paid.
JURISDICTION
In the event of any legal action, the laws of North Carolina will apply, and only the courts located in Wake County, Raleigh, NC will have jurisdiction over the parties to this agreement.
This agreement shall be governed in all aspects by the laws of the United States of America and by the laws of the state of North Carolina. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in North Carolina as applicable, for any matter arising out of — or relating to — this agreement.
If any provision of this agreement is found to be unenforceable, all other clauses shall remain unchanged and in full force and effect.
THIRD-PARTY DATA
To the extent any third-party data, results or information is provided as a case study, or otherwise presented to a customer, such information is anecdotal only and The COMPANY has not performed any independent verification of the statements made by those individuals. Such information, if provided, is provided for exemplar purposes only. Past performance data and testimonials are not to be construed as an indication, promise, or projection of possible future employability or success.
PRIVACY POLICY
Our Commitment to Privacy: The CLIENT’S privacy is very important to us. We use the information you provide about yourself solely for the purpose of completing your order. We do not, under any circumstances share your personal information with outside parties, except to the extent necessary to complete your order. We never use or share the personally identifiable information that you provide in any way unrelated to the ways just described. We use return e-mail addresses, mailing addresses and telephone numbers to provide you with updates about your orders, to provide answers to any questions or concerns that you may have or to send marketing materials. Your e-mail addresses, mailing addresses and telephone numbers are not shared with any outside parties and they are used only for the professional purposes stated above.
LINKS TO THIRD PARTY WEBSITES
Our website and internal systems may provide links, such as hyperlinks or buttons, directing access to third party websites. The Resume Fix does not control or monitor these sites. The Resume Fix shall not be held responsible for any material, information, or content posted on these linked third-party websites. The inclusion of such linked sites does not imply any relationship, association, sponsorship or endorsement between The Resume Fix and the owner(s) of the linked sites. The Resume Fix includes links to these sites solely for your convenience. You are solely responsible for your access of these sites, and you will use your own judgment, caution and discretion when using these linked sites.
OTHER
The COMPANY reserves the right to modify, adjust, or increase the prices of our services at any time and without prior notice. Such adjustments may reflect changes in market conditions, cost of services, or other operational factors. Price changes will be effective immediately upon posting on our website or any other notification method deemed appropriate. Clients with ongoing service agreements will be notified of any price changes that may affect their current service terms. Continued use of our services after a price change constitutes acceptance of the new prices.
The COMPANY reserves the right to update, modify, or amend these terms and conditions at our sole discretion and without prior notice. Changes to these terms and conditions will be effective immediately upon posting on our website or via any other communication method we choose. It is your responsibility to review these terms and conditions periodically for updates. Your continued use of our services following the posting of any changes to these terms and conditions constitutes acceptance of those changes.
ACTS OF GOD
The CLIENT acknowledges that The COMPANY is not responsible for work that is not completed in a timely manner due to acts of God, mechanical failure, or other circumstances beyond the control of company.
The CLIENT declares that he/she has read, understands, and accepts the terms and conditions
in this agreement.
